Interesting thread. I have physical media stored away for all my computer served music. The only discs I spin are SACD, vinyl, and DVD/Blu-Ray.

Content providers as represented by the RIAA and DMCA do not believe the fair use doctine applies to anything they produce, and take every opportunity to expand on that position.

The quick and dirty answer is there has been no legal precedent in the courts or by the RIAA addressing this specifically and in reality there is no way to police any of it.

However, just because it cannot be policed, doesn't make it legal.

This excerpt from the RIAA pretty well summarizes what most believe the law is RIAA - The Law - December 30, 2012

Copying CDs

•It’s okay to copy music onto an analog cassette, but not for commercial purposes.
•It’s also okay to copy music onto special Audio CD-R’s, mini-discs, and digital tapes (because royalties have been paid on them) – but, again, not for commercial purposes.
•Beyond that, there’s no legal "right" to copy the copyrighted music on a CD onto a CD-R. However, burning a copy of CD onto a CD-R, or transferring a copy onto your computer hard drive or your portable music player, won’t usually raise concerns so long as:
•The copy is made from an authorized original CD that you legitimately own
•The copy is just for your personal use. It’s not a personal use – in fact, it’s illegal – to give away the copy or lend it to others for copying.

Happy Holidays Folks,

Bob
The key here being "the copy" - not the original. Anyway...I agree. Lets just keep all our originals. It's smart anyway and keeps things on the whiter side of gray.

Default DVD and Blu-Ray

Somebody asked about DVD's.

With DVD's and Blu-Ray, it's Catch 22 in the US. It's murky.

The sale and use of DVD copy protection circumvention is clearly illegal in the US. Real Networks lost the legal CSS license Case. The Kaledescape case is still in court and has not been fully resolved. These are the good guys in my opinion.

The DMCA makes it illegal to manufacture or distribute tools that circumvent copy protection. So in order to create a backup of a copy protected work, one would need to use an illegal tool. While it may well be fair use for you to store a backup copy of a personally owned DVD on your own computer, a federal law has nonetheless made it illegal to manufacture or traffic in the tool you need to make such copies. That is the 'Catch-22'.

So, bizarre as it seems, there is today in the US no legal way to watch a DVD that I own on my iPad, since I am not aware of a legal tool to make the transfer.
